Welcome to Airos (“Company,” “we,” “our,” or “us”).
These Terms of Service (“Terms”) govern your access to and use of our website https://airos-usa.com (the “Site”) and our associated products, software, and services (collectively, the “Services”).

By accessing or using our Services, you agree to these Terms. If you do not agree, please do not use our Services.

1. Acceptance of Terms

By using our Services, you confirm that you are at least 18 years old, have the legal capacity to enter into a binding contract, and agree to comply with these Terms and all applicable laws.

2. Description of Services

Airos provides AI-driven marketing solutions for businesses, including but not limited to:

  • AI Receptionist and Lead Dialer systems

  • AI Chatbots and website integrations

  • Automated SMS and email follow-up tools

  • AI-integrated websites and sales funnels

  • Campaign management, analytics, and optimization services

The exact features available to you may depend on your chosen service plan or custom agreement.

3. Account Registration

To use certain Services, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information.

  • Maintain the security of your account credentials.

  • Notify us immediately of unauthorized access or use of your account.

You are responsible for all activities conducted under your account.

4. Payments and Billing

A. Fees

All fees are listed in U.S. dollars unless otherwise specified.
You agree to pay all applicable fees for the Services you select according to the pricing and payment terms presented at the time of purchase.

B. Recurring Payments

Some Services are billed on a recurring (monthly or annual) basis. You authorize Airos to charge your chosen payment method automatically until you cancel in accordance with Section 5.

C. Late Payments

Failure to pay may result in suspension or termination of your Services. Unpaid amounts may accrue late fees and collection costs.

5. 14-Day Money-Back Satisfaction Guarantee

We stand behind the quality of our work and your satisfaction.

  • You are eligible for a 100% refund if you are not satisfied within 14 calendar days of your service being set up and launched (the “Start Date”).

  • The 14-day period begins when your system, website, or automation goes live, not when your initial payment is made.

  • To request a refund, you must email billing@airos-usa.com within the 14-day window, explaining the reason for your request.

  • After the 14-day period, all fees are non-refundable.

This guarantee applies to initial setup services and monthly plans, but does not cover add-on customization work, third-party platform costs, or ongoing campaign expenses already incurred on your behalf (e.g., hosting fees).

6. Cancellations and Termination

You may cancel your subscription or service at any time by contacting billing@airos-usa.com.
Upon cancellation:

  • Your Services will remain active through the end of the current billing period.

  • After 14 days from launch, no prorated or partial refunds will be issued.
    We reserve the right to suspend or terminate your access if you violate these Terms or misuse our systems.

7. Acceptable Use Policy

You agree not to use our Services to:

  • Violate any law or regulation.

  • Send spam, phishing messages, or misleading content.

  • Upload, transmit, or distribute viruses, malware, or harmful code.

  • Collect or store personal data of others without consent.

  • Interfere with or disrupt the security or performance of our systems.

  • Impersonate any person or entity.

Airos reserves the right to monitor system usage and terminate accounts engaging in abuse or illegal activity.

8. Intellectual Property

All content, design, trademarks, logos, and software used in our Services are the property of Airos or its licensors.
You are granted a limited, non-transferable, revocable license to use the Services for your internal business purposes only.
You may not:

  • Copy, modify, distribute, or create derivative works.

  • Reverse-engineer or decompile any software.

  • Use our branding or materials without written permission.

9. Data & Privacy

Our collection and use of personal data are governed by our Privacy Policy, which is incorporated into these Terms by reference.
By using our Services, you consent to our data practices, including AI-powered automation and analytics systems.

10. AI and Automation Disclaimer

Our Services may use artificial intelligence, automated systems, or machine learning models to respond to inquiries, generate messages, and optimize marketing efforts.
You acknowledge and agree that:

  • AI interactions may not always be accurate or error-free.

  • Airos is not liable for any losses resulting from automated communications or AI-generated responses.

  • You remain responsible for reviewing and approving any automated outputs before acting upon them.

11. Third-Party Services

Our Services may integrate or interact with third-party tools (such as Google, Meta, Twilio, Stripe, or GoHighLevel).
We are not responsible for the content, security, or practices of these third parties.
Your use of third-party platforms is governed by their respective terms.

12. Disclaimers

The Services are provided “as is” and “as available.”
Airos makes no warranties or representations, express or implied, including but not limited to:

  • Accuracy or reliability of automated data or AI outputs.

  • Fitness for a particular purpose.

  • Non-infringement of third-party rights.

We do not guarantee uninterrupted, error-free, or secure access to our Services.

13. Limitation of Liability

To the fullest extent permitted by law, Airos and its affiliates, officers, employees, and contractors shall not be liable for:

  • Any indirect, incidental, or consequential damages.

  • Loss of profits, data, or business opportunities.

  • Errors in AI automation, communication, or marketing output.

Our total liability in any matter arising from or related to the Services will not exceed the total fees paid by you to Airos in the 3 months preceding the event.

14. Indemnification

You agree to indemnify and hold harmless Airos and its affiliates from any claims, damages, or expenses arising from:

  • Your use or misuse of the Services.

  • Violation of these Terms.

  • Infringement of any third-party rights.

15. Modifications to the Services or Terms

We may update, modify, or discontinue any part of our Services at any time without prior notice.
We may also revise these Terms from time to time.
The “Last Updated” date will always indicate the latest version. Continued use after changes signifies your acceptance of the updated Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to conflict of law principles.
Any disputes shall be resolved exclusively in state or federal courts located in St. Louis County, Missouri.
